D.lgs. 6 September 2005 n 206 (consumer code)
The sale made on this site is a distance contract ("Contract") pursuant to art. 50 and ss. D.Lgs. 6 September 2005, n. 206 ("Consumer Code").
The object of the Contract is the sale of movable property between La Contadinetta srl, with registered office in Via Peschioli 20 66046 Tornareccio Chieti and the buyer ("Customer"). The Contract is concluded through the acceptance by the customer of the purchase proposal made via the internet on this website and/ or through other distance selling systems such as in some cases, the telephone proposal.
Purchases made on a website, are included in the category distance teleshopping ( outside of business premises ) and are protected by D.Lgs n.185 of 22 May 1999. The Legislative Decree n.185 of 22 May 1999 provides for the possibility for the Consumer to exercise the right of withdrawal for the goods purchased at a distance. The Consumer may exercise the right of withdrawal within a period of 10 working days from receipt of the goods by returning the goods purchased to the Supplier. The Customer must not pay any penalty, has no obligation to specify the reason for the return and is entitled to a refund of the purchase price of the goods.
These general conditions of sale ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumer Code, remain valid and effective until they are modified and/ or supplemented by La Contadinetta srl. Any amendments and/or additions to the General Conditions will be effective from the date on which they are communicated to the public and will apply to sales made from that date. The latest updated version of the General Conditions is the one available on the Site.
Product Prices
The sales prices of the products shown on the Site and/or through any other distance selling systems are shown both inclusive of VAT and any other taxes, and net of taxes.
Shipping prices
The delivery costs are provided to the customer both on the Site during the various stages of conclusion of the order and/ or through any other distance sales systems, in the case of telephone order, repeated to the Customer by the operator of Contadinetta srl.
Shipping costs for returning products
The shipping costs of returning products in the event of exercising the right of withdrawal shall be borne by the Customer.
The shipping costs of returning products are our responsibility when it is ascertained that the order was wrong for reasons to be attributed to the management of the order by Contadinetta srl.
Method of conclusion of purchase and payment
In the case of a customer who contacts Contadinetta srl by telephone, by making a request for products, only after he has provided the data necessary for the registration of the customer card, the contract by telephone is concluded by informing the Customer that the proposal is accepted.
In case of purchase proposals sent through the Site, the Customer will receive from La Contadinetta srl a summary e-mail, with which he will be informed that his purchase proposal is being processed and will be deemed accepted, unless otherwise communicated and-mail or telephone transmitted by La Contadinetta srl within the deadline of 7 ( seven ) calendar days from receipt of the summary email. After this period, the Internet Contract shall be considered completed.
The customer will be allowed to choose one of the following payment methods:
by paypal, to be made at the time of sending order;
by cash on delivery, to be made to the courier, before delivery and opening of the package;
by advance transfer, to be made after sending the order and in advance to the shipment of the same; the package will be sent only after the credit of the value of the order on our C/ C
Through other payment systems that will be added by La Contadinetta srl ;
Exclusions
The right of withdrawal applies to natural persons acting for purposes not related to their professional activity.
Therefore, purchases made by retailers and companies are excluded from the right of withdrawal.
The right of withdrawal also does not apply to the following categories of products:
audiovisual or sealed computer software media opened by the consumer;
newspapers, periodicals and magazines.
Extensions to companies and special cases
In the specific case of products processed on this site, you can apply the right of withdrawal.
However, in special cases, even if the customer is a company, if serious errors are found on our part or directly attributable to our beams in production, which make the product unusable,We will evaluate the case and provide for a replacement that eliminates the error and makes the product usable and compliant with the requirements.
This is in view of a good practice of the seller, with the aim of meeting the needs of the customer.
In the event that purchase errors are caused by your inexperience or distraction in configuring the order on the site, we are not required to refund and/or replace the wrong product. However, we will try to find the best solution for you.
Applicability and validity of the guarantee
The products
products damaged by accidents, causes or negligence of third parties will not be replaced or reimbursed;
in the unfortunate event of an incorrect shipment by us, we will assume the costs for the return shipment of the wrong product and the sending of the correct products;
the products subject to the right of withdrawal must be returned by the consumer, in conditions of substantial integrity, sending them to our headquarters.
Lack of conformity
The seller is obliged to deliver to the consumer goods in accordance with the contract of sale.
For lack of conformity is to be understood a product that does not conform to the description indicated by www.lacontadinetta.it, on the product sheet.
Deliveries of products
The delivery of the purchased products will take place at the address indicated by the customer in the sections of this site dedicated to the purpose during the order conclusion (or purchase contract).
Any errors in filling in the delivery address or the possible selection of the wrong delivery address by the Customer are not attributable to Contadinetta srl and any delays in delivery that may result will not entitle the Customer to cancel the purchase contract concluded.
Availability of products
The customer’s orders are accepted by Contadinetta srl within the limits of the quantity of products available. therefore the acceptance by the Farmer of the purchase proposal submitted by the customer and subject to the availability of the products themselves.
The farmer srl undertakes to communicate any unforeseeable unavailability of products due to excess demand or other causes.
In case of lack of availability, the customer accepts a maximum waiting time of 30 working days for the Contadinetta srl to replenish its product warehouse and satisfy the order.
in the event of inability to meet the order concluded by the customer, Contadinetta srl will be required to refund only the full value of the order possibly already paid by the customer in advance, including shipping costs.
No other value or damage caused by waiting by the customer, beyond the value of the order , will be due by Contadinetta srl to the customer.
Obligations of the customer
The customer declares and guarantees:
to be a consumer according to art. 3 of the Consumer Code;
to have reached the age of 18 and therefore to be of age;
that the data provided by the same for the execution of this Purchase Agreement are correct and truthful;
the Customer assumes all liability arising from false or false statements made on this Site;.
Right of withdrawal
The Customer has the right to withdraw from this purchase agreement concluded at the time of conclusion of an order on this website, without any penalty and without specifying the reason, within 10 days of receipt of the products. The Customer may exercise the right of withdrawal, within the aforementioned period, by means of a written communication Contadinetta srl, to be sent by e-mail to info@lacontadinetta.it.
The Customer wishing to exercise the right of withdrawal must return the products to the address indicated in the invoice within 10 days of receipt of the products.
The Customer shall not have the right of withdrawal in the following cases:
supply of sealed consumables (sealed packages) open and/or already partially used by the Customer
products whose packaging (product box, product label) is damaged or partially damaged
product not complete with its accessories and manuals and original packaging or with verification code (scratch code) scratched and tested (the verification is disposable)
The costs of returning the products are borne by the customer ,La Contadinetta restitura ,within 30 days from the date of receipt of the products by the customer the full price paid by the customer, net of shipping costs, in case of return of the product, complete with all its parts and functionality, returned in its original packaging.
Place of jurisdiction
The Contract is governed by Italian law. Any dispute relating to its application, execution, interpretation and violation of the Contract will be the responsibility of the Court of Lanciano (CH).
